The protection of Personal Data is very important to Preisner Productions, the owner of the Preisner Store online shop available at www.store.preisner.com. In this Privacy Policy, we would like to inform the Customers of Preisner Store about how we process their Personal Data, as well as outline their rights under Regulation (EU) 2016/679 General Data Protection Regulation (GDPR) or otherwise applicable national regulations. All capitalised terms used in this Privacy Notice shall have the meaning as defined in the GDPR.

Customers of the Preisner Store are. persons using the services provided by the Data Controller through the Store, as defined in the General Conditions of Sale (GCS) of the Preisner Store, as well as persons visiting the Preisner Store website. This Privacy Policy is an integral part of GCS.

What Personal Data does Preisner Productions collect about you?

As part of our business operations, we processes your Personal Data that is necessary to execute your Order made on our website mentioned above.Preisner Productions may process your Personal Data obtained directly from you on the basis of a purchase order you have made on our website for the following purposes:

- The Customer's consent in accordance with Article 6(1)(a) GDPR, if required;

- Art. 6(1)(b) GDPR - to process an Order placed on our website;

- Article 6(1)(f) GDPR - when justified by the legitimate interests of the Controller, such as the possibility of establishing, investigating or defending against claims.

The customer may withdraw his/her consent at any time.

The following categories of Personal Data are mainly collected in the context of your contractual or commercial relation to Preisner Productions:

  • Basic data: first name, last name, contact data, e-mail address, phone number; 

  • Payment data: Payment method, Payment date.

On what basis does Preisner Productions processes Personal Data?

Preisner Productions processes Personal Data on the basis of:

- your consent as per Article 6(1)(a) GDPR,where it is required;

- Article 6(1)(b) GDPR – execution of Order you have made on our website;

- Article 6(1)(f) GDPR – whenever it is justified by Data Controller’s legitimate interest, eg. in being able to establish, assert or defend against claims.

  1. DATA RETENTION PERIOD

For how long does Preisner Productions store your Personal Data?

To the extent that the processing of Personal Data is based on consent, the data will be processed until the consent is withdrawn, but no longer than the expiry of the below retention periods:

Your Personal Data will be stored for the entire period of order processing and for an additional 5 years from the end of the calendar year in which the order was placed.

Where necessary and justified, your Personal Data will be kept for the period necessary to establish, assert or defend against claims.

  1. RECIPIENTS OF THE DATA

Who can access the Customer's Personal Data?

All Personal Data is used exclusively by Preisner Productions or its service providers and can only be accessed by authorised persons.

External recipients of the data are Preisner Productions' subcontractors (technical service providers responsible for hosting the shop website or IT support, payment service providers and invoicing services).

Where we entrust Data Processing in order to fulfil our obligations towards the Customer to Processors, their Personal Data is processed in accordance with the relevant Data Processing Agreement.

Outside the European Union (EU) or the European Economic Area (EEA), we may transfer Personal Data only to third countries for which an adequate level of protection has been confirmed by the EU Commission or for which other adequate data protection guarantees (e.g. binding internal company data protection regulations or EU standard contractual clauses) are in place or legal circumstances permit the transfer. In addition, where required by applicable data protection laws, further safeguards (e.g. encryption and additional contractual arrangements) will be put in place to ensure an adequate level of protection for your Personal Data

What are the security measures put in place by Preisner Productions?

With regard to the risks that presents processing of Personal Data in the course of its commercial operations, Preisner Productions takes appropriate measures to maintain security and confidentiality of your Personal Data, in particular to prevent data from being destroyed, compromised or accessed by unauthorized third parties.

Preisner Productions chooses solely those subcontractors and service providers that provide for high security standards.

7. YOUR RIGHTS IN RELATION TO YOUR PERSONAL DATA 

In relation to our processing of Personal Data, Customers have the following rights:

Right to withdraw consent 

To the extent the processing of Personal Data is based on the consent, you have the right to withdraw your consent at any time. Withdrawal of consent does not affect the lawfulness of the processing previously carried out on that basis. 

Right to information 

You may request information as to whether your Personal Data is being processed. If this is the case, you may request further information, in particular on the purposes of processing, the categories of Personal Data processed, the recipients, the storage period or, if this is not possible, the criteria for determining the period, as well as further information. You may request a copy of your Personal Data, which will be provided to you in the event of a request by e-mail in a commonly used electronic format, provided that this does not adversely affect the rights or freedoms of other persons. 

Right to rectification 

You may request that we correct any inaccurate Personal Data relating to you or complete any incomplete Personal Data without undue delay. 

Right to erasure 

You may request the immediate deletion of your Personal Data. Your Personal Data will only be stored by us for as long as it is required for the specified purpose or for as long as we are required by law to retain the data. As soon as the purpose has been fulfilled or your Personal Data is no longer required for data processing, we will delete it. 

In addition, it is possible to process your Personal Data for another purpose in compliance with the statutory provisions, for example: assertion or defence against legal claims. This purpose only exists as long as the limitation periods allow the assertion of legal claims. 

Right to restriction 

You may request the restriction of the processing of your Personal Data, in particular if 

- you dispute its accuracy and the data is being reviewed, 

- the processing is unlawful and you refuse to have it deleted, 

- the data is no longer required but you need it to assert, exercise or defend legal claims, or 

or defence of legal claims, or 

- you have objected to the processing. 

Right to data portability 

At your request, we will transfer your data - insofar as this is technically possible - to another responsible party. However, you only have this right if the data processing is based on your consent or is necessary to perform a contract. Instead of receiving a copy of your data, you can also ask us to transfer the data directly to another data controller specified by you. 

Right to object 

You may object to the processing of Personal Data concerning you if the processing is based on a legitimate interest (Article 6(1), first sentence, point (f) GDPR. The data will then no longer be processed unless compelling reasons for the processing are not demonstrated. 

Preisner Productions would like to inform you that modifying or failing to provide your data may have impact on the processing of the Order and that any requests regarding exercising your rights will be kept for documentation purposes.

Any request must include your full name and address and must be emailed to store@preisner.com, or posted to Preisner Productions.

You also have the right to lodge a complaint with a relevant supervisory authority, in particular in the Member State of our or your residence or the place of the alleged infringement, if you consider that the processing infringes the General Data Protection Regulation.
